{"id":1917,"date":"2024-12-05T12:01:26","date_gmt":"2024-12-05T12:01:26","guid":{"rendered":"https:\/\/sxg.vfh.mybluehost.me\/website_e3b0ab15\/?p=1917"},"modified":"2024-12-05T12:01:26","modified_gmt":"2024-12-05T12:01:26","slug":"cual-es-el-procedimiento-correcto-para-realizar-un-despido","status":"publish","type":"post","link":"https:\/\/laboralista.pe\/en\/cual-es-el-procedimiento-correcto-para-realizar-un-despido\/","title":{"rendered":"\u00bfCu\u00e1l es el procedimiento correcto para realizar un despido?"},"content":{"rendered":"<p>Sin bien el empleador puede finalizar la contrataci\u00f3n de un trabajador ante una causa justa relacionada con la capacidad o la conducta del trabajador, este procedimiento legal se debe realizar de la siguiente manera:<\/p>\n<ol>\n<li>El empleador debe enviar una carta de pre aviso de despido al trabajador, la cual muchas veces la denomina \u00abimputaci\u00f3n de cargos\u00bb. En este documento se deben se\u00f1alar los hechos que ocasionan la falta grave cometida y se debe otorgar al trabajador un plazo m\u00ednimo de seis (6) d\u00edas naturales para que este pueda efectuar su descargo respectivo.<\/li>\n<li>En caso de tratarse de una causa relacionada con la capacidad, el plazo que se le otorga al trabajador es de 30 d\u00edas naturales con la finalidad de que este demuestre su capacidad o corrija su deficiencia.<\/li>\n<li>Es importante recordar que cuando el empleador se encuentre ante una falta grave flagrante por parte del empleado (y no sea razonable otorgar al trabajador el derecho de defensa), el empleador est\u00e1 habilitado para cursas directamente la carta de despido sin necesidad de cursar previamente la carta de preaviso.<\/li>\n<li>Tener en cuenta que mientras dure el tr\u00e1mite del despido, y siempre que est\u00e9 relacionado exclusivamente con la conducta del trabajador, el empleador puede exonerarlo por escrito de asistir al centro de trabajo, solo si ello no perjudica su derecho de defensa y se le abonan la remuneraci\u00f3n, derechos y beneficios que pudieran corresponderle<\/li>\n<li>El empleador, luego de vencido el plazo de 6 d\u00edas naturales, puede cursar la carta de despido al trabajador. \u00a0En dicha carta debe se\u00f1alarse de modo preciso la causa del mismo y la fecha del cese. En caso que el trabajador no quiera recibirla, el empleador la debe remitir por intermedio de notario o de juez de paz y, a falta de ellos, mediante la autoridad policial.<\/li>\n<li>Se debe tomar en consideraci\u00f3n que el empleador no puede invocar posteriormente causa distinta de la imputada en la carta de despido.
