Asimismo, advierte que este derecho implica ser tratado de igual modo respecto a quienes se encuentran en una situaci\u00f3n id\u00e9ntica: igualdad ante la ley.<\/p>\n<p>En ese sentido, nos recuerda que la legislaci\u00f3n peruana brinda una protecci\u00f3n a los trabajadores frente a actos de discriminaci\u00f3n que se producen por motivos prohibidos, tales como: \u00a0el origen social del la persona , raza, color, sexo, edad, idioma, religi\u00f3n, opini\u00f3n, ascendencia nacional, condici\u00f3n econ\u00f3mica, ejercicio de la libertad sindical, discapacidad, portar el virus del VIH.<\/p>\n<p>No obstante, el TFL manifiesta que esta lista no es taxativa, o cerrada, sino por el contrario, se trata de una lista abierta- De esta manera, los trabajadores est\u00e1n protegidos contra actos discriminatorios fundados\u00a0<strong class=\"x-el x-el-span c2-32 c2-33 c2-3 c2-4s c2-1g c2-3y c2-4t\">\u00aben cualquier otra \u00edndole\u00bb.<\/strong><\/p>\n<p>Ahora, para que un comportamiento fundado \u00aben cualquier otra \u00edndole\u00bb sea considerado discriminatorio, luego del an\u00e1lisis y valoraci\u00f3n, se debe determinar que este acto no sea razonable ni proporcional.<\/p>\n<p>Es importante tener en cuenta que los actos de discriminaci\u00f3n salarial por motivos prohibidos recogidos en la Constituci\u00f3n son particularmente graves y deben ser sancionados con especial severidad.
